The Impact of Swiss Blocking Statutes on Cross-border Internal Investigations – Taking Stock in 2020
Companies and individuals are increasingly confronted with the challenge of navigating Swiss blocking statutes when trying to cooperate with foreign authorities and provide them with responsive material based in Switzerland.
The typical issue in cross-border investigations is the transfer of data from Switzerland to foreign authorities. Several legal provisions restrict the disclosure of such data, including the prohibition of unlawful activities on behalf of a foreign state (section 271 of the Swiss Criminal Code) and the Swiss data protection and labour laws. The Swiss Federal Supreme Court recently held that unauthorized transmission of certain third-party information to foreign authorities is a breach of the Swiss Criminal Code.
When foreign authorities request information located in Switzerland, companies and individuals accordingly often face a challenging risk calculus: comply with the request at the risk of violating Swiss laws or jeopardise valuable cooperation credit.
Against this background, Dr. Juerg Bloch, LL.M., Partner at Niederer Kraft Frey and MLaw Daniel S. Weber, LL.M., Counsel at Wenger & Vieli, will provide the Working Group with an introduction of the common roadblocks that can arise in an investigation involving Switzerland and how companies and individuals can best position themselves to address them. Juerg and Daniel are experienced investigation attorneys and recently commented on section 271 in a leading Swiss legal commentary.
