The session will explore the U.S. Department of Justice’s Corporate Whistleblower Awards Pilot Program with effect as of August 1, 2024, and its significant impact on Swiss companies. This new policy, a vital component of the DOJ’s efforts to enforce corporate compliance and anti-corruption, has far-reaching implications for businesses outside the U.S., including those in Switzerland. We’ll examine how Swiss companies with U.S. ties are affected, the legal and financial implications involved, and discuss strategies companies can adopt taking this new policy into account. Finally, we will discuss whether and how this new policy affects compliance officers of Swiss companies.
As speakers we have two distinguished individuals:
Caleb Sainsbury is a U.S. qualified attorney with over 10 years’ experience in major law firms in both the United States and Switzerland. Caleb is a partner in Baker McKenzie’s compliance, investigations and ethics practice groups and frequently represents individuals and multi-national companies in disputes with Swiss and United States authorities. Caleb graduated from Boston University School of law and currently makes his home in Switzerland.
Kaspar Projer is a Swiss qualified attorney with over seven years of experience in two Zurich-based leading law firms. Kaspar is an associate in Baker McKenzie’s dispute resolution, trade and commerce and compliance, investigations and ethics practice groups. Kaspar is experienced in complex multijurisdictional disputes at the intersection of private, public and administrative criminal law. His practice covers a broad range of compliance areas, including export controls, international and Swiss sanctions, anti-money laundering, anti-bribery and corruption, as well as investigations in these sectors. Kaspar holds title from University of St. Gallen, University of Zurich and University College London.
